Los Angeles, California (November 16, 2010) - Christie, Parker & Hale LLP, one of Southern California's leading intellectual property law firms, announced today that the firm prosecuted another major patent application through issuance, for its client, Guardian ProStar, Inc. of Grand Junction, Colorado.
"We are excited to have played a significant role in the issuance of this patent for our client," said Raymond R. Tabandeh, the CPH partner who prosecuted the patent." The patent, U.S. Pat. No. 7,834,806, pertains to collecting and managing data and information about utility assets buried under the ground. This data is required to make numerous business decisions like how, when and where excavators should or should not be digging the ground. The asset data is collected and integrated with GIS landbase and topography data in a precision grid, in real time. The data may then be stored to be utilized by the utility, construction, government, and other organizations. The extensive data may be integrated with commercially available map data, such as Google Map™.
"Inaccurate mapping and lack of sharing of buried asset location management information continues to be a major problem throughout the U.S. and abroad. Events, including the recent gas pipeline explosion in San Bruno, California, which resulted in several loss of lives and significant damage to the environment, are directly related to ineffective asset data management practices and inaccurate data." Tabandeh added.
ProStar’s Chief Executive Officer, Page Tucker stated: "The nation’s infrastructure highway and roadway, as well as the buried infrastructure that includes the gas lines, fiber optic, sewer and water lines are aging. Additionally, the increased construction activities in congested underground corridors add significant concerns to an already problematic situation. When coupled with poor planning and inaccurate asset location practices that have existed for several decades, you have a serious problem on your hands. This problem must be addressed, otherwise, recent catastrophic events that we have witnessed will continue to occur."
This latest patent adds increased value to a growing IP portfolio of ProStar that offers unique processes for precision data collection, storage and distribution, as well as excavation guidance systems.

LOS ANGELES, Calif. (October 19, 2010)—Intellectual property law firm Christie, Parker & Hale, LLP today announced that its client, Vederi, LLC, has filed a patent infringement suit in federal court in the Central District of California against Google. The complaint alleges that Google's Street View product infringes four of Vederi's patents by allowing a user to visually navigate streets within a geographic area.
Enrico Di Bernardo and Luis Goncalves, the founders of Vederi, LLC, met at Caltech while pursuing doctoral degrees. In 2000, when Luis was looking for a new apartment and wanted to know about different neighborhoods, they conceived of the idea to build a system to let Internet users look at street-level views of neighborhoods. They envisioned that their service could be syndicated in a number of online properties, including travel sites, business listings, real-estate listings, map and directions sites. That July, Luis and Enrico drove around Pasadena in Enrico's personal car, with a camera mounted on top of the car, collecting images and corresponding GPS coordinates for their first system, the ScoutTool, later renamed the StreetBrowser. The StreetBrowser system, that lets Internet visitors look at panoramas of streets and visually navigate around a neighborhood, was hosted on the website of the City of Pasadena for several years in the early 2000s. Vederi's first provisional patent application for its system was filed in October 2000.

U.S. Pat. No. 7,639,159 pertains to a method and system for automatically determining right of way for "smart cars," or cars equipped with "smart" mobile units, at an intersection. The method and system include collecting position and movement information about a number of "smart" mobile units approaching an intersection, and delivers automated determination and dissemination of right-of-way information. The right-of-way indicator may prove beneficial in reducing the large number of collisions that occur annually.

(December 17, 2009) – Christie, Parker & Hale LLP (CPH), one of Southern California’s leading intellectual property law firms announced today that the firm obtained an award of attorneys' fees on behalf of a group of defendants for whom CPH had earlier obtained a summary judgment of noninfringement.
Patent holding company International Intellectual Management Corporation ("IIMC") had asserted infringement of three patents by a number of defendants engaged in the import and sale of blankets, including CPH clients Lee Yunn Enterprises, Inc. (U.S.A.), American Jiamei Textile, Awad Manufacturing, Inc., Chung’s Appliance, Inc., J.J.P, Inc., Kim’s Home Center, Inc., L.A. Home Fashion, Inc., S & L, and Sung’s Home Collection.
After the Court granted defendants' motion for summary judgment, CPH filed a motion on defendants' behalf seeking reimbursement of the attorneys' and expert witness fees defendants had incurred in defending the lawsuit. The Court granted the motion, finding that IIMC had not performed a proper investigation before filing suit, and that it was improper for an employee of IIMC's law firm(who is also an officer of IIMC) to have contacted one of the defendants directly. In imposing an award of more than $275,000 in attorneys' fees against IIMC and its counsel, the Park Law Firm, the Court found that CPH's rates and overall fees were reasonable. The Court also awarded CPH's clients more than $34,000 in expert witness fees.
CPH's litigation team included CPH attorneys Brian K. Brookey, Thomas J. Daly, G. Warren Bleeker, and Steven E. Lauridsen. "At CPH, we pride ourselves in providing excellent representation at a lower cost than that typically charged by larger law firms," said Brookey, who was lead counsel on the matter. "Patent litigation can be very expensive, so we are especially pleased that having represented our nine clients in this action in a very cost-effective manner, we also were able to obtain an order providing for reimbursement of fees."

After CPH filed a motion for summary judgment, IIMC dropped any claim that one of the patents in suit was infringed. The Court granted summary judgment as to the remaining claims, sustaining all of CPH's objections to IIMC's expert testimony, and finding that Defendants had established they did not infringe any of the asserted patents.
"We are gratified that the Court granted our clients' motion," said CPH litigation partner Brian K. Brookey, who was lead counsel on the matter. "We believed from the beginning of the case that it never should have been brought, and are glad we were able to obtain a judgment in our clients' favor without the expense of going to trial." Brookey added that the next step in the case will be to seek an award of attorneys' fees from IIMC to compensate Defendants for their costs incurred in defending the matter.

LOS ANGELES (April 14, 2009)--Christie, Parker & Hale LLP, one of Southern California’s leading intellectual property law firms, announced today that the firm has obtained a judgment for its client, Tacori Enterprises, a Jewelry manufacturer based in Los Angeles, in the amount of $1,182,336.01, as well as a permanent injunction against Beverlly Jewellry Company, from the U.S. District Court, Central District of California.
The judgment includes $832,245.25 in damages and $350,090.76 in attorneys' fees. Tacori’s suit against Beverlly was based on the fact that Beverlly was selling and manufacturing rings that were sufficiently similar to rings bearing the "Tacori Look", such that an ordinary person might be confused and erroneously assume that Beverlly’s rings were associated with Tacori. The ruling stated that Tacori "has shown it is entitled to relief for copyright and trade dress infringement. "
Tacori claimed in its suit that Beverlly Jewelry manufactured and sold rings that were "confusingly similar" to its own copyrighted ring designs and infringed the "Tacori Look" trade dress.

LOS ANGELES, Calif. (February 4, 2009)—Intellectual property law firm Christie, Parker & Hale, LLP today announced a U.S. District Court Judge affirmed awards totaling $9.1 million in damages to its client, Human Touch® LLC. The awards resulted from a trademark/trade dress infringement and unfair competition action brought against KingKong USA, Inc., and American Lighting Industry, Inc., and an action against WFO Imports LLC for infringing U.S. Patent No. 6,629,940 through the sale of more than 5,000 massage chairs.
Judge Valerie Baker Fairbank, of the United States District Court for the Central District of California, affirmed awards of $4.55 million against American Lighting Industry, $2.8 million against KingKong and $1.73 million against WFO Imports.
In September a federal court jury determined that Human Touch has protectable trade dress rights in the chair which had been infringed by KingKong and American Lighting Industry, which had also intentionally committed acts of unfair competition.
The jury found that WFO Imports had infringed the patent, referred to as the "940 patent," which covers the design of the Human Touch HTT-10 model massage chair.
Attorneys David Dillard and Art Hasan led the Christie, Parker & Hale legal team that prosecuted the case.
"We are very pleased that Judge Fairbank affirmed these awards, which recognized the truly innovative nature of this product," Dillard said. LOS ANGELES, Calif. (January 19, 2009)—Intellectual property law firm Christie, Parker & Hale, LLP today reported that a United States District judge has approved a consent judgment and permanent injunction that acknowledges the validity of copyright and trade dress protections for rings designed by a Glendale, Calif., jeweler, and requires the infringing Ohio-based manufacturer to pay $650,000 in attorney fees and disgorgement of profits.
The prevailing party in the case is Tacori Enterprises, represented by Christie, Parker & Hale. The defendant is Rego Manufacturing of Bucyrus, Ohio.
The order by Judge Kathleen M. O’Malley of the United States District Court, Northern District of Ohio, permanently enjoins Rego from copying Tacori products, or infringing on the trade dress of Tacori jewelry.
The settlement also found that Rego non-willfully infringed on Tacori copyrights when it purchased certain rings from Beverlly Jewellery Company Limited, of Hong Kong. The copyrighted rings each contain Tacori’s signature crescent designs.
The settlement followed a Summary Judgment issued by Judge O’Malley against Rego. Rego had argued that Tacori Enterprises’ copyright and trade dress claims were not valid, alleging that the ring designs were not original, and that similar designs have existed "for thousands of years." The Court rejected this argument, finding that the ring design was "independently created" and "original" to Tacori. Earlier, Judge O’Malley held that Rego violated its duty under Rule 11 of the Federal Rules of Civil Procedure by relying on fabricated documents, and sanctioned Rego over $40,000.
The Rego injunction follows the judgment and injunction issued last year of another copyright and trademark infringement brought by Tacori against Pink Diamond, Inc. Judge Gary Allen Feess of the United States District Court, Central District of California, approved a settlement in which Pink Diamond agreed to pay $150,000 in damages and profit disgorgement based on Pink Diamond’s infringement of Tacori’s copyrights and trade dress rights.
"Our client is gratified by the ruling entered by Judge O’Malley in Ohio, as well as the earlier judgment issued by the District Court in California," said Howard A. NEWPORT BEACH & PASADENA, Calif. (January 6, 2009) – Christie, Parker & Hale LLP, one of Southern California’s leading intellectual property law firms, announced that its team of attorneys won the largest ever cybersquatting judgment, $33.15 million, on behalf of its client, Verizon.
A Federal court in the Northern District of California made the ruling in late December on a case in which OnlineNIC, a San Francisco-based Internet domain name registration company, tried to take advantage of Verizon and its customers by using at least 663 Internet domain names that were easily confused with legitimate Verizon domain names. The infringing Verizon domain addresses displayed ads that would generate revenue for OnlineNIC.
In its ruling, the court concluded that OnlineNIC’s bad-faith registrations of Verizon-related domain names were designed to attract Internet users seeking to access Verizon’s legitimate websites, and calculated an award based on $50,000 per domain name.
"Our client, Verizon, is highly gratified by this ruling," said Christie, Parker & Hale partner David Steele, who prosecuted the case. "Our aim with this case was to send a clear message and to deter cybersquatters who continue to run businesses for the primary purpose of misleading Verizon consumers, or consumers of other legitimate companies, as well."

The jury also awarded Human Touch—the leading U.S. marketer of Robotic Massage® chairs—$2.8 million against co-defendant KingKong U.S.A., Inc, and $425,000 against KingKong’s president, Bernard Koay.
Both federally registered and unregistered marks, all which include the name Human Touch, were found to be valid and infringed. The jury also determined that Human Touch had protectable trade dress rights in the revolutionary design and overall appearance of its HTT-10 model massage chair and that KingKong had infringed on those rights. Defendant Koay was found to have induced infringement by KingKong. The jury held that all defendants had committed acts of unfair competition and that all defendants acted intentionally.
In a related action, Christie, Parker & Hale announced separately today that another U.S. District Court jury awarded $1.7 million in damages to Human Touch in a patent infringement action brought against WFO Imports LLC which does business as Premier Health Products. In that matter, the jury validated Human Touch’s rights to U.S. Patent No. 6,629,940 (referred to as the ‘940 patent), which describes a new and greatly improved lower leg massage mechanism used in the footrest portion of a massage chair.

Human Touch filed suit against defendant WFO Imports LLC in 2006 in the Central District of California, alleging that WFO Imports LLC infringed the '940 patent through its sales of over 5,000 chairs with lower leg massagers. The jury recognized the validity of the '940 patent and awarded Human Touch $1.7 million in damages.
In a related action, Christie, Parker & Hale announced separately today that another U.S. District Court jury awarded $4.55 million to Human Touch on trademark, trade dress, and unfair competition claims brought against American Lighting Industry, Inc. and other parties.

LOS ANGELES, Calif. (Aug. 21, 2008)—A United States Magistrate Judge has ruled that eight major retailers and apparel manufacturers did not infringe on a patent designed to conceal a woman's nipples under sheer clothing.
The prevailing defendants are Victoria’s Secret Stores, LLC; Nordstrom, Inc.; The Neiman Marcus Group, Inc.; Gap, Inc.; Federated Department Stores, Inc.; Dillard’s, Inc.; Bragel International, Inc. and Ce Soir Lingerie Co., Inc. The eight defendants were represented by Christie, Parker & Hale, LLP, a Southern California intellectual property law firm.
Judge John D. Love of the United States District Court for the Eastern District of Texas granted summary judgment dismissing a lawsuit by Randi Black, owner of a patent that teaches a method to cover a nipple. Judge Love found the patent to be invalid because it was an obvious combination of teachings from prior patents.
The accused product was the highly successful NuBraÒ, which is produced by Bragel International and sold by major retailers including co-defendants Victoria's Secret, Nordstrom's, Neiman Marcus, Macy's and Dillard’s. Black attempted to show that her patent was novel based on the commercial success of the NuBra. However, in his ruling, the judge found the arguments presented by Black to be "unpersuasive" because she was unable to show that the success of the NuBra and its ability to enhance the cleavage of the wearer of the product was due to the features of Black's patent.
"Our clients are heartened by the rulings of Judge Love. This was a frivolous lawsuit which never should have been brought," said Ed Schwartz, the Christie, Parker & Hale litigation partner who led the defense team. (July 9, 2008) – Intellectual property law firm Christie, Parker & Hale, LLP today announced that the National Arbitration Forum (NAF) has ruled in favor of its client, Sigma Two Group LLC, the California-based manufacturer of FIREFLY MAGIC® simulated firefly lights for residential and commercial use, in a domain name dispute with a competitor, Avenstar.
Avenstar had registered the domain name magicalfireflies.com and was using it to sell competing goods. In its opinion, the NAF said that under the Uniform Domain Name Dispute Resolution Policy (UDRP), one competitor may not try to attract Internet users seeking a competitor’s goods to its own Website by using a domain name that is confusingly similar to a competitor’s trademark and domain name. (The UDRP applies to all .com, .net, .org, .biz, .info, and .mobi domain names.)
The NAF is a specialized worldwide panel of legal experts with trademark, copyright and e-commerce experience selected by ICANN (Internet Corporation for Assigned Names and Numbers) to oversee and administer domain name conflicts.
The panel found that: (1) the domain name magicalfireflies.com was identical or confusingly similar to Sigma Two’s trademarks and domain name of fireflymagic.com. (2) Avenstar had no rights or legitimate interest in the domain name magicalfireflies.com, and (3) Avenstar had registered and used the domain name magicalfireflies.com in bad faith. Accordingly, the panel ordered the domain name magicalfireflies.com be transferred to Sigma Two.
"This protection under the UDRP is especially important for competitors in niche markets that make products dependent upon Internet sales," said CPH partner Gary Nelson, who represented Sigma Two in the case. "A competitor’s use of a confusingly similar domain name can severely damage the reputation, sales and distribution network of another. It’s important for businesses with similar problems to know there is a speedy and relatively inexpensive dispute resolution process that may resolve their problem short of litigating in federal court."

(OTC: SLUP), for an environmentally safe method of remediating both elemental and ionic mercury from combustion gases emitted by coal-fired power-generating plants.
Concurrent with obtaining the patent protection, West Nyack, NY-based Solucorp, which focuses on the environmental remediation industry, entered into an exclusive global licensing agreement for its IFS-2C mercury-emission control technology with CoaLogix, Inc., a company 85 percent owned by Acorn Energy, Inc. (Nasdaq: ACFN).
The protections granted to the IFS-2C technology broaden Solucorp’s already substantial portfolio of United States and foreign patents and applications focusing on the capture and fixation of heavy metals in contaminated soil, water, paint dust, and other media, according to CPH partner John D. LOS ANGELES (March 5, 2008)—Christie, Parker & Hale LLP (CPH), one of Southern California's leading intellectual property law firms, today announced that it completed the sale of a U.S. patent earlier obtained on behalf of one of its clients, Dr. Irving Reed, a well-known mathematician and engineer in the area of telecommunications. Terms of the transaction were not disclosed.
The patent relates to communication technology and, more particularly, to a self-synchronizing adaptive multistage receiver for wireless communication systems. Specifically, the patent is directed to an adaptive near-far resistant receiver for wireless communication systems, such as asynchronous DS-CDMA systems without the use of prior synchronization. The only requirement for the receiver is knowledge of the spreading code of the desired user. Also there is no need of a training period or of data-free observations.
This technology may be used for voice and data communications, and is keenly suited for mobile phones. The identity of the buyer remains confidential, according to Raymond R. Tabandeh, the CPH partner who prosecuted the patent, negotiated and closed the deal.
Tabandeh said, "It was an honor to be able to work with Dr. Reed to prepare and obtain the patent. As people familiar with the industry know, Dr. Reed is best known for co-inventing error-correcting and error-detecting codes known as Reed-Solomon codes, as well as co-inventing Reed-Muller code.
